Matchhamster B.V. Terms and conditions

These terms and conditions apply to the services (the Matchhamster app and the Matchhamster app) provided by Matchhamster B.V. (we/our) to the user (you/your). By using (one of) our services, you agree to these terms and conditions. We can change these terms and conditions for the purposes of continuously improving our services. The most recent version of the terms and conditions always apply. In the event of changes, we publish this on our websites (www.matchhamster.com and www.Matchhamster.com), and in the applications if the change applies to the current agreements.
1. Our services
What we do for you
Our services allow you to compare your (own) texts with texts on web pages indexed by Google and Bing. You will receive an alert when there is a relevant match between your text and a text on the internet.
You can enter any text. It is possible to enter self-written texts, but it is not necessary. Entering the texts is easy: enter them one by one, or you link your website allowing new texts to be imported automatically. It is also possible to import texts via XML or RSS.
Comparing texts (matching)
Web pages which are indexed by Google and Bing can be found by anyone and are therefore relevant. The texts you have entered are compared with texts on web pages indexed by Google and Bing. This is done on the basis of our own search-and-match method. We establish to which extent the original text matches the text on the found web pages.
The matches refer to the web pages we have found, which can then be watched in real-time. We collect as much interesting information about the text we have found and the website where it was found, so that you can determine what to do with the information we have found. You can export and share the matches.
You can start using (one of) our services by entering your name, email address and password. You will be given a personal account. It is not permitted to open more than one account in your own name. You can however open an account for others. In that case, you will be the administrator of the group account.
If you suspect that another person is abusing your account, please inform us as soon as possible by sending an email to firstname.lastname@example.org.
You can always stop our services. You can terminate your account in one of the applications by sending a request thereto by email to email@example.com and we will terminate your account. The termination is final upon our confirmation thereof. Any balance still open will be cancelled and is not repaid.
You opt for a package when you apply and first start using our services. You can pay for the package via credit card (and Apple pay – not available yet in the Netherlands). The amount is directly debited.
If you no longer wish to pay for our service, first finish the package you have purchased, after which you will automatically switch to the free (freemium) package. For an upgrade to a more expensive package, you will also first finish the package you have already purchased. You can then choose a package of your choice. This package will be activated as soon as your payment has been made via credit card.

You use our service(s) at your own risk. We are not liable for any damage you may suffer as a result of the possible (temporary) unavailability of our service(s). We cannot guarantee that our service(s) will always be fully operational.
7. Rules of use
You are not permitted to use our service(s) for acts that violate Dutch or other applicable regulations and legislation. This includes the storage or publishing information that is slanderous, offensive or racist via the service.
8. Intellectual Property rights
The content of our services is protected by intellectual property rights. It is not permitted to make public (parts of), multiply or otherwise exploit our services. The data we collect and accrue always remains the property of Matchhamster B.V.
9. Complaints and disputes
Please inform us if you have a complaint. Send your complaint to email@example.com and we will respond within a week.
This agreement is governed by Dutch law. Disputes are settled by the competent court in Amsterdam.
